War schon die relativ frühe Entstehungszeit des polybianischen Geschichtswerkes dem Vertrauen in seine Glaubwürdigkeit durchaus zuträglich, so wurde dieses durch den Blick auf die intellektuelle Kraft des Geschichtsdenkers Polybios nur bestärkt. Daß historische Tatsachen freilich eher dem reflektierenden Geschichtsdeuter im Wege sind als dem nur konstatierenden Geschichtsschreiber, wurde allzu häufig übersehen. Zwischen Hannibal und dem Werk des Polybios liegt eine Zeitspanne von mehr als zwei Generationen. Das Wissen um die Geschichte des Zweiten Punischen Krieges verdankte Polybios ebenso wie seine Zeitgenossen allein noch einer schriftlichen Tradition, aus der sich, vom möglichen Einspruch der Augenzeugen unbehelligt, durch Verwertung oder Verwerfung einzelner Komponenten ein neues Bild der Ereignisse und ihrer Hintergründe zeichnen ließ. Daß die nachpolybianische Annalistik mit der Verformung der vorgefundenen Überlieferung das Ziel verfolgte, die römische Rechtsposition hinsichtlich der Kriegserklärung an Karthago durch fiktive Angaben über die damalige Vertragslage zu beschönigen, ist längst erkannt. Indes ist nicht oder jedenfalls nicht mit der nötigen Entschiedenheit die Frage erhoben worden, wodurch die annalistischen Erfindungen hervorgerufen wurden und in welchem Maße bereits Polybios retuschierend oder verfälschend in die Überlieferung der für den Kriegsausbruch maßgebenden Vertragssituation eingegriffen hat. / Content: A renewed study of the beginnings of the Second Punic War needs - like few other topics - justification: The world-historical importance of the event is beyond doubt, but it seems to have been sufficiently satisfied by a wealth of penetrating studies commensurate with the rank of the subject. The literature is hardly manageable any more, but whatever one sifts from it, there is an obvious consensus on one thing: the effort to connect in some way Hasdrubal's Ebro treaty and Hannibal's capture of Sagunt and to explain the second war fought between Rome and Carthage as the inevitable consequence of Hannibal's actions in Spain.This fundamental consensus reflects the Polybian view of the Second Punic War and at the same time marks the boundaries within which, regardless of other differences, the reconstruction of what happened will remain, as long as Polybios is demarcated as almost essentially different from later historiography and therefore exempt from the radical criticism that is considered unquestionably appropriate to annalistics. If the relatively early time of origin of the Polybian historical work was already quite conducive to confidence in its credibility, this was only strengthened by the view of the intellectual power of the historical thinker Polybios. The fact that historical facts are rather in the way of the reflecting historical interpreter than of the merely stating historian was too often overlooked. Between Hannibal and the work of Polybios lies a time span of more than two generations. The knowledge about the history of the Second Punic War owed Polybios as well as his contemporaries only to a written tradition, from which, untroubled by the possible objection of the eyewitnesses, a new picture of the events and their background could be drawn by utilizing or rejecting individual components. It has long been recognized that the post-Polybian annalistics, by deforming the existing tradition, pursued the goal of embellishing the Roman legal position with regard to the declaration of war on Carthage by fictitious statements about the contractual situation at that time. However, the question has not been raised, or at least not with the necessary determination, what caused the annalistic inventions and to what extent Polybios already intervened in a retouching or falsifying manner in the tradition of the contractual situation decisive for the outbreak of war. The study of the Roman municipia has been less popular, but during recent decades they too, have received an ever increasing amount of scholarly attention. In this light it is rather surprising that no general survey has been attempted on the fora except for Beloch's short chapter on them in his Der italische Bund unter Roms Hegemonie, which was published almost a hundred years ago, and the 'Forum' article by Schulten in Pauly-Wissowa's Real-Encyclopädie der klassischen Altertumswissenschaft1. No doubt the primary reason for this scholarly neglect of the fora has been the fact that for once, all problems seemed to have been neatly solved already long ago. Indeed, ever since the Renaissance2 it has been a unanimously accepted view that the fora were road-posts founded by Roman consuls or censors in connection with the building of the Roman Viae3. It is only quite recently that these ideas have received some airing by two scholars. Radke, while writing about Roman roads, claimed that the fora were founded not only as road-posts on the Viae, but exactly halfway along them4. On the other hand, while writing on Italian manpower, Brunt pointed out that all the fora need not have been founded during the same years the Roman roads were constructed5; incidentally, Beloch also suggested this, though so far little heed has been paid to his words6. The object of this study is to gain some fresh insight on the fora by focusing the attention on the fora themselves. To this purpose the concept forum, the prevalent ideas about the fora, their rise, dating, nomenclature, administration and territories will be discussed in the light of the ancient literary sources. Also the archaeological evidence which has never been discussed in connection with the fora will be dealt with, meagre though it is. Emblematic of the status of metic was the requirement to pay a special metic tax, the metoikion. And if a metic failed to pay this tax, he or she would be sold into slavery, a fate that threatened no citizen of the classical Athenian polis. In the late fourth century BC the Athenians, in the face of widespread departure of metics in the face of economic recession and legal harassment, moved to improve metics' legal situation in order to entice metics back to Athens. It is to the context of these legal reforms of the metic condition, this volume argues, that a celebrated set of fourth-century BC Athenian inscriptions recording dedications of silver cups, phialai, belong. Known since the nineteenth century as the "Attic Manumissions", these inscriptions have been thought to be the result of a legal process by which slaves were set free. Here these inscriptions are published as a corpus for the first time. And it is argued that they represent not the freeing of slaves, but preserve instead the traces of prosecutions of metics for failure to pay the metoikion. In the new pro-metic atmosphere of the 330s BC, persons who sued metics for failing to pay the metic tax, but did not win a conviction, were fined to discourage frivolous suits, and part of that fine was dedicated to divinity in the form of a phiale.
